You hereby grant HEREA RETAIL SA DE CV (hereinafter collectively referred to as “us,” “we,” or “HEREA”) a worldwide, non-exclusive, royalty-free license, including any moral rights, to use your username and any photos and/or moving content in connection with which you have responded #BEHEREBEREAL (hereinafter referred to as the “Posted Content”) for marketing and/or advertising purposes on our website, emails, and free and/or paid social media. 

You hereby represent and warrant that: 

     (A.) If you are not the holder of any intellectual property rights, you warrant that the holder of such rights has completely and effectively waived all such rights and has validly and irrevocably granted you the right to grant the license stated above;

      (B.) you acknowledge and agree that you are solely responsible for the form, content, and accuracy of any Posted Content;

      (C.) you agree that you will not post any false, inaccurate material or delete or revise any material that was not posted by you; 

      (D.) you assure that you are at least 16 years old, and; 

      (E.) HEREA’s use of your Posted Content will not violate any laws or third-party rights. 

You also release HEREA from any obligation to pay you for the use of your Posted Content and any relevant intellectual property rights in connection with the uses described above, and moreover, no liability shall result from the use of such information. 

HEREA has the absolute right to remove and/or delete any Posted Content that it deems objectionable without notice. You consent to such removal and/or deletion and waive any claim against HEREA for such removal and/or deletion.
